The Supreme Court has sent a notice to the state of West Bengal and has stayed all further proceedings before the Calcutta High Court. This happened after an unusual conflict between a single judge and a division bench. The issue at hand concerns alleged irregularities in the issuance of reserved category certificates and the admission of MBBS candidates in state-run medical colleges and hospitals.
The Supreme Court has taken suo moto cognizance of an order passed by a single bench of the Calcutta High Court that declared "illegal and ignored" an order issued by a division bench in a case involving alleged irregularities in the admission of MBBS candidates to state-run medical colleges and hospitals.
Reportedly. five-judge constitution bench, led by Chief Justice CJI DY Chandrachud, will now hold a special hearing on January 29.
According to a report by Livemint, the conflict arose after the Calcutta High Court's single-judge bench and division bench issued opposing orders to each other. Justice Abhijit Gangopadhyay's order accused Justice Soumen Sen, who heads the division bench, of representing a political party in West Bengal. He accused the latter of deciding to ' save some political party in power' and claimed Justice Sen's actions were misconduct.
The single-judge bench also directed authorities to ignore the division bench order and asked the CBI to launch an investigation into the fake caste certificate case. On January 24, the Bengal Police were also asked to provide CBI documents related to the case.
The order was stayed earlier this week after it was brought before a division bench consisting of Justice Sen and Uday Kumar. However, this did not last long. Justice Gangopadhyay's single-judge bench took up the case again, this time requesting that the West Bengal police hand over the paper to the CBI. The division bench disagreed on Thursday, so the single judge heard the case again and made comments about Justice Sen.
