On Monday, The Supreme Court deferred the hearing of Delhi Chief Minister Arvind Kejriwal's plea to June 26.
On June 23, he filed a petition in the Supreme Court challenging the Delhi High Court's suspension of the bail granted to him by a trial court in the Delhi excise policy case on Thursday.
A vacation bench comprising Justices Manoj Misra and SVN Bhatti decided to await the pronouncement of the Delhi High Court's final order on the bail suspension, which is expected to be delivered tomorrow.
Now, the next hearing is scheduled for June 26, directing that the High Court’s stay order, if passed in the interim, should be placed on record.
“How do we know what is going on in the High Court’s mind?" Justice Misra remarked during the hearing, noting that it was “unusual” for orders to be reserved in stay applications as they are typically pronounced on the spot. Anyway, we will have it the day after tomorrow.”
Senior advocate A.M. Singhvi, representing Kejriwal in Supreme Court, argued that the stay on the bail order was a violation of the fundamental right to personal liberty.
Singhvi emphasised that it was “unprecedented” for any court to stay a bail order on the first day of the hearing itself.
He asserted, “We should not have suffered a stay at all. This is a question of personal liberty.”
Delhi HC Ordered Stay on Kejriwal Release
On June 20, a Delhi court granted bail to Arvind Kejriwal, who had been arrested by the Enforcement Directorate (ED) in connection with a money laundering case related to the Delhi Excise policy of 2021-22.
However, After ED approached Delhi High Court challenging Kejriwal’s release, Delhi HC suspended the trial court's bail order, following a day-long hearing on June 21.
