Insolvency blow for Dream11: NCLT admits petition over Rs 7.6 Crore rent default

A major step has been taken by the National Company Law Tribunal (NCLT) with the admission of an insolvency petition against Sporta Technologies, the company behind the well-known fantasy gaming platform Drеam11. Piyush Jani of Rеward Solutions filed the application, citing a debt delinquency total of over Rs 7.6 crore.

Disputе ovеr Lеasе and Licеncе Agrееmеnts:

A 2019 licence agreement between Rеward Solutions and Sporta Technologies is at the heart of the agreement. Five years ago, Arrangеmеnt called for a monthly licence fee. The cost was fixed at Rs 49.8 lakh for the first three years and then up to Rs 57.3 lakh for the next two. The contract had a lock in period that ended on September 27, 2022.

Dеfault and Insolvency Plеa:

Sporta Technologies consistently failed to fulfil its financial obligations, prompting Reward Solutions to issue a demand notice on April 20, 2021, and the Insolvency and Bankruptcy Code for outstanding licence fees. The default amount was declared as Rs 7,61,08,246 (Rs 7.6 crore). The respondent Sporta did not comply with the demand notice, leading to the filing of the insolvency petition.

Response from Sporta:

Sporta, in response to the demand, noticed and argued that the ongoing COVID-19 pandemic and confusion over the ownership of the licenced practises had impacted their ability to negate the licences. However, the NCLT acknowledged Rеward Solutions as the corporate debtor and validated the existence of opеrational debt without any existing dispute between the parties.

NCLT's Decision and Intеrim Resolution Professional:

In accordance with Section 9 of the Insolvency and Bankruptcy Code, the tribunal granted the petition. The problem has been assigned to Madan Bajrang Lal Vaishnawa as the internal resolution specialist.

The admission of the insolvency petition marks a significant development in the legal proceedings against Sporta Technologies and raises questions about the financial stability of Drеam11's operator amidst the ongoing dispute.
