Supreme Court Declares Electoral Bonds Unconstitutional, Opposition Cheers

The Supreme Court delivered a landmark verdict on Thursday, declaring the Electoral Bond Scheme unconstitutional.The apex court said the scheme violates people's right to information and Article 14 of the Constitution guaranteeing equality and struck it down. 

The decision, passed by a five-judge bench, addressed concerns about the scheme's violation of the citizens' right to information and equality, guaranteed in the Constitution. The five-judge bench of Chief Justice DY Chandrachud, Justice JB Pardiwala, Justice Sanjiv Khanna, Justice BR Gavai, and Justice Manoj Misra presented the unanimous decision.

In a significant development, the State Bank of India has also been instructed by the top judiciary body to submit details of the electoral bonds purchased. since the interim order dated April 12, 2019 until date to the ECI within a three-week time frame.

The apex court observed that the electoral bond scheme infringes on the principle of free and fair elections as stipulated in the constitution.It is learned that CPM, the Congress leader, and the non-profit Association for Democratic Reforms approached the Supreme Court for the proceeding.

The Polit Bureau of the CPI (M) commended the landmark decision of the Supreme Court.which has called the electoral bond scheme unconstitutional. The CPI (M) earlier announced at the outset that they would not accept electoral bonds.as this scheme legalises corruption. 

"It is gratifying that the main contentions set out in the petition against the scheme have been upheld. It is essential now that reforms for political and electoral funding are introduced to ensure transparency. clean funding and a level playing field," reads a release from CPIM. 

As the top court dropped a legal bombshell with its groundbreaking verdict, Vygr attempted to contact Advocate Prashant Bhushan. but Thursday found his cellular phone unanswered.
