Setback to Rahul Gandhi: Gujrat HC rejects appeal in defamation case

The Gujarat High Court's decision has been seen as a major setback for Rahul Gandhi as he won't be able to contest elections next year. Also, he is no longer Minister of Parliament.

Rahul Gandhi's one comment made in 2019 has brought him to this position where his appeal to put a stay on his conviction in the criminal defamation case was dismissed by a court on Friday, 7 July. Right after that, he took a decision to appeal to the Supreme Court. Till the process of appeal is completed, no arrest can happen to Rahul Gandhi. 

In the 2019 election campaign in Karnataka, Rahul Gandhi commented on 'Modi' surname saying, "why do all thieves have Modi surname? Lalit Modi, Nirav Modi, Narendra Modi." 

Nirav Modi is an escapee. He is an Indian tycoon and Lalit Modi was Chief of the IPL but then BCCI banned him for life. Putting Narendra Modi's name in this category made his supporters angry. They said, "it's not Modi's defamation but it defamed the entire Modi community." While giving support to his own statement, Rahul Gandhi said that he was putting some light on corruption. 

In this entire defamation case, Rahul Gandhi's conviction in SC in March 2023, disqualified him as an MP. His lawyer Abhishek Manu Singhvi said, "The BJP government is trying to manipulate and control freedom of speech and expression. They misused the law of defamation." But the ruling party countered this saying, " law and order was followed in the case."

In all these happening a stay or suspension on his conviction appeal is a crucial point in putting him back as an MP.
