Allahabad High Court today dismissed a plea made by the Anjuman Intezamia Masjid Committee which had advised against the survey. The plea was against an order passed by a Varanasi court that had allowed the Archaeological Survey of India to conduct a survey of the Gyanvapi Mosque.
By dismissing the plea of Anjuman Intezamia Masjid Committee, the A0llahabad High Court has paved the way for a scientific survey. The Allahabad High Court had given a verdict on the same on July 27.
"Issue of a commission is permissible. The Varanasi Court was justified in ordering an ASI survey of the premises. The scientific survey is necessary in the interest of justice, " Allahabad High Court Chief Justice Pritinker Diwaker said, according to live law.
The highly controversial survey is supposed to determine whether the Gyanvapi Mosque is constructed on a pre-existing construction or not, to be precise a temple. The Muslim side says that since the structure is very old, a survey might lead to damage to the structure. The Hindu side says that a dome or fountain-like structure inside the Gyanvapi Mosque is a Shivling.
On July 21, 2023, a Varanasi district court allowed for the commencement of a survey at the Gyanvapi Mosque by a team from the Archaeological Survey of India. The ‘Wazukhana’ is exempted from it. ‘Wazukhana’ is an absolution pond inside a Mosque, where people wash themselves before praying. The Varanasi district court has asked the ASI team to submit its report by tomorrow, August 4, 2023.
