Government Revises Bill for Safeguarding Election Officers

Today, the Rajya Sabha will consider a contentious bill that would designate the nation's top three election officials. However, the administration has made significant modifications to the bill in response to criticism from a range of sources.

The Supreme Court's ruling in March, which mandated a panel consisting of the Prime Minister, the Chief Justice of India, and the leader of the opposition for the selection of the Chief Election Commissioner and election commissioners, led to the introduction of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023.

In response to petitions seeking a collegium-like mechanism for the selection of the election commissioners to guarantee transparency, the Supreme Court had stated that a representation of the single-largest opposition party would be on the panel if there is no leader of the opposition in the Lok Sabha. After facing fierce opposition from the opposition, the government chose not to present the bill to the September special session. According to sources, the law has undergone significant modifications to safeguard election commissioners from sudden dismissal. The government's proposal to substitute a Union Minister for the Chief Justice of India on the selection panel was a major source of disagreement.

Proposals to deprive the Chief Election Commissioner and other election commissioners of their status as Supreme Court judges and to make their salaries comparable to those of the Cabinet Secretary also sparked opposition to the measure. The Chief Election Commissioner and Election Commissioners would continue to have the same standing as Supreme Court judges, despite the government's decision to keep the option to replace the Chief Justice of India with a Union Cabinet member on the selection panel. As a major demand of the former chiefs of the electoral board, this will also guarantee that the electoral Commissioners cannot be removed unless the Chief Election Commissioner recommends it.

Additionally, the law suggested forming an initial search committee including the Cabinet secretary and two other senior officials in order to gather five names to be considered by the selection panel. Another significant change that has recently been implemented is the Union Law Minister's replacement of the Cabinet secretary on this committee. The opposition has contended that substituting a Union Cabinet minister for the Chief Justice of India on the selection panel would go against the Supreme Court's ruling because it would give the executive back complete control over choosing the election commissioners, as it would have two of the committee's three members.

It was bad that there was no defined qualification up until this point, meaning that anyone from the street may be appointed as an election commissioner. It is a positive thing that the new bill states that only secretarial-rank officials or their equivalents will be posted," Mr. Quraishi had stated. According to Mr. Quraishi, the administration received a thorough submission on the law that adhered to the spirit of the Constitution.
