MeitY Revokes Approval Requirement for AI Models in India

A major change in the Ministry of Electronics and Information Technology's (MeitY) position regarding the approval procedure for platforms that use AI models has occurred recently. The new advice, which was released on March 15, 2024, does away with the need for platforms to request permission from the government before implementing AI models that are still in development. This action was taken in response to criticism from startup entrepreneurs regarding the prior advice that was released on March 1.

Key Points of the New Advisory:

1. Intermediaries no longer need to submit an action taken-cum-status report but must comply immediately with the revised guidelines.

2. The advisory emphasises the importance of intermediaries implementing due diligence as per existing IT rules.

3. Platforms must label AI-generated content, especially that vulnerable to deepfake manipulation.

4. AI models should be used to prevent the sharing of unlawful content.

5. MeitY stresses the need for easy identification of deepfakes and misinformation, recommending labelling or embedding content with unique identifiers.

6. The label or identifier should indicate if content is artificially generated and if the intermediary's resources were used for modification.

Major social media platforms, including Facebook, Instagram, WhatsApp, Google/YouTube, Twitter, Snap, Microsoft/LinkedIn, and ShareChat, are among the ones targeted by the advice. These platforms were previously the subject of contentious March 1 advice as well as a deepfake alert in December 2023.

MeitY's updated advice takes a more balanced approach to controlling AI models and moderating content on digital platforms. The ministry hopes to improve openness and accountability in the digital sphere by putting a strong emphasis on the labelling of AI-generated content and the prevention of disinformation.
