Mahua Moitra's plea for urgent hearing on expulsion deferred; CJI to decide on the matter

Chief Justice of India D Y Chandrachud will decide whether to list Trinamool Congress (TMC) leader Mahua Moitra's appeal contesting her removal from the Lok Sabha, the Supreme Court announced on Wednesday.

Before a bench consisting of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia, Moitra's case was mentioned for urgent listing.After mentioning the plea, senior lawyer Abhishek Singhvi was told by Justice Kaul, "The CJI will take the call,"

A five-judge Constitution bench led by Chief Justice CJI Chandrachud convened on Wednesday to hear a case. Following the adoption of the House's ethics committee report, which found the TMC leader guilty of receiving gifts and illicit gratuities from a businessman to serve his interests, the leader of the party has filed an appeal with the highest court, contesting her expulsion from the Lok Sabha.

The resolution to remove the TMC MP from the House for "unethical conduct" was submitted by Parliamentary Affairs Minister Pralhad Joshi on December 8, following a contentious debate in the Lok Sabha over the panel report during which Moitra was not permitted to participate. The motion was approved by a voice vote.

Moitra had reacted angrily to her dismissal, comparing it to being hanged by a "kangaroo court" and accusing the administration of using a parliamentary panel as a tool to control the opposition.
