SCBA Condemns the Bar Council of India's Opposition to Same-Sex Marriage, Saying it's 'Highly Inappropriate'

The Bar Council of India's (BCI) statement opposing the Supreme Court hearing on marriage equality was condemned by the Supreme Court Bar Association (SCBA) on Friday.

In a statement, the SCBA Executive Committee stated that it felt it was extremely inappropriate for the BCI to oppose a hearing of the case before the Supreme Court by issuing a press statement on April 23, 2023.

The BCI passed a resolution on April 23 rejecting the country's legalisation of same-sex unions.

The resolution was approved by the bar, according to BCI Chairman Manan Kumar Mishra, following a meeting with members from all State Bar Councils.

"It is the duty of the Court to hear the petition and decide whether the matter should be adjudicated by the Court or left to the wisdom of Parliament. This resolution should not be construed in any manner that we are supporting or opposing the petitioner in the matter pending before the Supreme Court," SCBA said.

The Constitution Bench started hearing the petitions on same-sex marriage on April 18.
