On May 11, the Karnataka High Court dismissed a goods and services tax notice issued against Gameskraft Technology, a Bengaluru-based online gaming corporation, for alleged Rs 21,000 crore in evasion. A GST intelligence unit issued the greatest such accusation in the history of indirect taxation against Gameskraft Technology in September 2022, claiming the company had failed to pay Rs 21,000 crore in GST. From 2017 to June 30, 2022, the notice was in effect.
Rummy Culture, Gamezy, and Rummy Time are just a few of the card, casual, and fantasy games that were allegedly used to promote online gambling by Gameskraft Technology Private Limited (GTPL), according to another accusation. Apparently, Gameskraft was not submitting invoices to its customers, according to the officials. Inspectors from GST applied a tax of 28% to wagers worth close to Rs 77,000 crore. Due to GTPL's policy of allowing customers to wager money on the outcomes of online card games, the authorities alleged that the company engaged in gambling. They claimed that the gambling platform submitted erroneous or outdated invoices, which were discovered during a forensic assessment of the files. They also claimed that the company was pressuring its customers to wager money because there was no way to get their money back once it had been put into their accounts.
However, the Bengaluru-based firm said that its services met the criteria for skill-based gaming activities, which are subject to only 18 percent GST on the platform cost, which the business subtracted from players' entry fees. According to the statement, the cost typically varied between 5 and 15 percent of the contest registration price, with the remaining funds going towards the prize pool for the players.
Gameskraft's group general counsel, Joyjyoti Misra, stated in response to the High Court's ruling, "We are quite satisfied with the judgment of the Karnataka High Court. It is a strong endorsement of our corporate approach. We had and still have complete faith in both the legislative and judicial branches. We are hopeful that this ruling will pave the way for meaningful dialogue with the GST authorities and lay the groundwork for progressive, sector-specific GST rules. Gamezy, a multi-game platform that was introduced in 2017 and is a part of Gameskraft's portfolio of platforms for real-money gambling, offers games like online ludo, fantasy sports, and rummy.
