The Bombay High Court has issued a stern warning to the BMC (Municipal Corporation of Greater Mumbai) after a controversial demolition was carried out in record time.
Justice Mylan Jadhav criticized the municipal body for wrapping up the entire legal process –from notice to the final demolition – in just 13 days, calling the move "high-handed" and questioning the suspicious urgency behind the action. 🏗️⚖️
The court’s primary concern is whether the affected party was given a genuine, fair opportunity to represent their side or if the administrative process was merely a formality for a predetermined outcome.
In a rare move, the Court warned the BMC that if the demolition is ultimately found to be illegal, the corporation may be forced to reconstruct the structure at its own expense.
This case serves as a critical reminder that while authorities have the power to act, they cannot bypass the fundamental right to a fair hearing. 🏛️🚨
