40% of MPs have Criminal Cases against them, 25% have serious ones, ADR says

According to recent research by the Association of Democratic Reforms (ADR) and New Election Watch (NEW), 25% of lawmakers are facing serious charges like murder, attempted murder, kidnapping, and crimes against women. Forty percent of sitting MPs have criminal cases filed against them.

The report, titled “Analysis of Sitting MPs from Lok Sabha and Rajya Sabha of India 2023”, was released on Tuesday (September 12).

Out of the 776 Lok Sabha and Rajya Sabha seats nationwide, it analyzes the self-sworn affidavits that 763 current MPs submitted before running in their most recent elections and subsequent by-elections.

According to the report, there are four vacant Lok Sabha seats, one open Rajya Sabha seat, and four unfilled Rajya Sabha seats from Jammu & Kashmir.

It further stated that because they were unavailable, the affidavits of three Rajya Sabha MPs and one Lok Sabha MP could not be examined.

According to the research, 306 of the 763 currently serving MPs under investigation (or 40%) have filed criminal charges against themselves.

Because its lone MP has filed criminal charges against himself, Lakshadweep is the state and union territory with the highest percentage of MPs who have criminal cases.

Kerala is next, where 23 out of 29 MPs (or 79% of them) have active criminal cases. Next, Telangana (54%) has 13 out of 24 MPs, followed by Bihar (73%) with 41 of 56 MPs, Maharashtra (57%) with 37 of 65 MPs, and Delhi (50%) with five out of ten MPs declaring criminal cases against themselves in their affidavits.

Additionally, the study discovered that 194 of these current MPs (or 25%) have major criminal charges against them, including kidnapping, murder, attempted murder, crimes against women, etc.

Lakshadweep once again takes the lead with 100% of the MPs involved in major criminal charges.

Bihar comes in second place (50%) with 28 of the 56 MPs in that state facing serious criminal charges. Following it are Uttar Pradesh (34%) with 37 out of 108 MPs, Maharashtra (34%) with 22 out of 65 MPs, Telangana (38%) with nine out of 24 MPs, and Kerala (34%) with ten out of 29 MPs.

The Rashtriya Janata Dal (RJD) has the greatest proportion of MPs who are involved in criminal charges, according to the research. 83% of the party's MPs, or five out of six, have active criminal prosecutions.

This is preceded by the Communist Party of India (Marxist) (CPI(M)) with 75% or six out of eight MPs, the Congress (53%) with 43 out of 81 MPs, the YSR Congress Party (YSCRP) (42%) with 13 out of 31 MPs, the Trinamool Congress (AITC) (39%) with 14 out of 36 MPs, the Nationalist Congress Party (NCP) (38%) with two out of eight MPs, the BJP (36%) with 139 out of 385 MPs and the Aam Aadmi Party (AAP) (27%) with three out of 11 MPs receiving criminal allegations against them.

The RJD once again leads in terms of the percentage of MPs who have significant criminal cases against them, with three of its six MPs, or 50%, having such cases.
