In Pune, A speeding Porsche was involved in an accident that killed two people. A 17 year old minor driving the Porscche car was arrested, but he was granted bail by the Juvenile Justice Board 15 hours after his arrest. Despite the deadly collision, the court said, the crime was not serious enough to deny bail, imposing several conditions on his release.
The Bail Conditions include:
- The accused must work with the traffic police in Yerawada for 15 days.
- The accused must write a 300 word essay on the accident on topic “effect of road accidents and their solution"
- Undergoing psychiatric evaluation in a hospital in Pune, counselling and submit a report with 15 days
- Seeking rehabilitation at a de-addiction centre.'
- Studying traffic rules and giving a presentation on the same to the Juvenile Justice Board.
- Assisting accident victims in the future, if he witnesses one.
Accident Details
Aneesh Awadhiya and Ashwini Koshta, two young engineers from Madhya Pradesh, were killed when their motorcycle collided with a speeding Porsche, which was being driven by a minor, near Kalyani Nagar in Pune. Aneesh Awadhiya and Ashwini Koshta were on their way home from a restaurant with friends, CCTV footage reveals.
The accident occured on Sunday at around 3:15 a.m, when a motorcycle was hit from behind by a speeding Porsche at the Kalyani Nagar junction. The force of the collision caused Ashwini to be thrown roughly about 20 feet into the air and land hard, while Aneesh was flung against a parked car and suffered serious injuries.The luxury car then crashed into pavement guardrails next to the road.
An eyewitness, auto-rickshaw operator, described. "The car was at full speed travelling at over 200 km per hour and did not have any number plate. After hitting the bike, the driver attempted to run away from the incident site, but the airbags in the car when opened obstructed his view. He parked the car, and locals quickly caught him and started beating him. There were three people in the Porsche but one managed to escape.
According to reports, the driver of the Porsche, who is said to be the son of a well-known local builder, was celebrating with friends after finishing their Class 12 exams. He was driving the Porsche even though he was just 17, four months under the legal driving age of eighteen. The minor had been drinking at a local pub with his two friends.
Police Detained him into custody
The witness stated that the police arrived at the scene in fifteen minutes.
Vijay Kumar Magar, Deputy Commissioner of Police, verified the arrest and the current investigation. "We are confirming the accused's age and have filed a formal complaint. "We're investigating the matter," he said.
Pune City Commissioner of Police (CP) Amitesh Kumar, said "We have registered a case under Section 304 (causing the death of any person by doing any rash or negligent act not amounting to culpable homicide) of the Indian Penal Code (IPC)."
The police have accused the minor of reckless and careless driving, causing harm, and endangering life or personal safety, based on the Maharashtra Motor Vehicle Act and sections 304A, 279, 337, 338, and 427 of the Indian Penal Code, said the DCP.
He went on, "Because he was a minor, we have sent the court an application asking for the minor to be tried as an adult." However, The permission has been denied by the court.
"An additional complaint has been filed against the minor's father, as the car was also registered in his name,” he said.
The case has also been registered against the individual who served him alcohol.”
The minor's father and the bar that served him alcohol are facing charges under Sections 75 and 77 of the Juvenile Justice Act, according to the Pune city police.
