Meloni said her justice and interior ministers and an undersecretary are also targeted in the investigation for supporting Osama Elmasri  Njeem also known as Osama  Almasri Njeem.  A video posted on social media told that  Meloni’s government has been under fire from the opposition human rights groups and the ICC itself for releasing al Masri on a technicality after he was arrested in the northern city of Turin on a warrant from the international court.

Meloni argued on social media posts that the ICC warrant was issued only after Njeem arrived in Italy, despite him having spent around 12 days in three other European Countries.

Meloni explained that the International arrest warrant had not been transferred to the Justice Ministry as required by Law,” and for this reason, the Appeals Court in Rome decided not to confirm the arrest”.

Rome prosecutors opened an investigation against Prime Minister Georgia Meloni and two government ministers for patriating a Libyan Wariord wanted by the International Criminal Court in the Hague, the Italian premier announced on Tuesday. Italy detained Njeem in the city of Turin earlier this month, but the government unexpectedly released him two days later. Njeem was then flown on an official state aircraft to Tripoli. 

In a video message posted to social media on Tuesday, Meloni said she had been placed under investigation by Rome’s chief prosecutor, Francesco Lo Voi, for allegedly aiding and abetting a crime and misuse of public funds.

Meloni pushed back on allegations of wrongdoing, saying that she “will not be blackmailed” and “will not be intimidated over an investigation” Meloni said the prosecutors had also placed Justice Minister Matteo Piantedosi and the cabinet undersecretary for intelligence matters under investigation.

The Italian government unexpectedly freed Osama Elmasry Njeem because of a legal technicality.

The Italian Government has close relations with the internationally recognized Government in Tripoli.

Any trial in The Hague of Njeem would have brought unwanted attention to Italy’s migration policies and its support of the Libyan coast guard, which it has financed to prevent migrants from leaving.

Some senators expressed dismay that Italy ignored its obligations to the ICC to turn over suspects. Italy’s Interior Minister says a Libyan man detained under the international war crimes arrest warrant and then unexpectedly released had been swiftly repatriated because of his “social dangerousness”

International Criminal Court has demanded answers from Italy over why it freed a Libyan man suspected of crimes against humanity and war crimes, as well as murder, torture, and rape.

Italy detained Osama Elmasry Njeem on Sunday in Turin after receiving a tip-off from The Hague-based ICC which had issued an International arrest warrant against Njeem. 

Njeem is the head of the Tripoli branch of the Reform  And Rehabilitation Institution, a notorious network of detention centers run by the government-backed Special Defence Force. Njeem is believed to have been in charge of Tripoli’s Mitiga Detention Centre and is wanted on charges including murder, rape, and sexual violence and torture, committed since February 15, 2015

The ICC, which has been investigating alleged serious crimes committed in Libya since the country’s 2011 civil war, said in a statement it had urged Italy to contact its staff if there were any problems with the arrest process. 

However, It said Njeem had been let go without prior notice or consultation.

“The Court is seeking and is yet to obtain verification, from the authorities on the steps reportedly taken,” The ICC said. 

“The Court recalls the duty of all (member States) to cooperate fully with the Court in its investigations and prosecutions of crimes,” The ICC statement said.

At the same time, the court continued to pursue its engagement with the Italian authorities to ensure the effective execution of all steps required by the Rome Statute for the implementation of the Court’s request. In this context, the Registry also reminded the Italian Authorities that in the event they identify any problems that may impede or prevent the execution of the present request for cooperation, they should consult the Court without delay in order to resolve the International matter.
