X Corp, previously known as Twitter, is currently involved in a legal dispute in a federal court located in Florida. The plaintiff, X Social Media, a legal marketing agency, argues that the social media giant's recent name alteration to include the letter "X" violates their trademark. This lawsuit has arisen due to concerns about possible confusion among consumers.
This legal action is likely to be the first of many trademark conflicts involving Musk's company, specifically related to the letter "X," which is commonly used in the branding of the tech industry. It is worth mentioning that the letter "X" is included in multiple federal trademarks owned by companies like Microsoft and Meta Platforms. Recently, X Corp has filed its own U.S. trademark application for this letter.
Currently, X Corp has not yet released a statement in response to the complaint, and X Social Media has chosen not to provide any comments at this time.
X Social Media, with its headquarters in Windermere, Florida, specializes in advertising campaigns centred around mass-tort litigation. It was founded in 2015 by Jacob and Roseanna Malherbe with the aim of facilitating connections between Florida panhandle residents and attorneys following the Deepwater Horizon oil spill in the Gulf of Mexico.
As stated in the lawsuit, X Social Media has been using the name "X Social Media" since 2016 and holds a federal trademark for it. They claim to have invested a significant amount, over $400 million, in Facebook advertising to attract potential clients. The company argues that Twitter's rebranding has caused customer confusion and a decline in revenue.
The lawsuit kindly requests an injunction to prohibit Musk's company from using the "X" name and requests unspecified monetary damages.
