Big Relief for 'Hamare Baraah' Makers! The Bombay High Court have given the green light for the release of the Annu Kapoor-starrer film, after its release was stayed on allegations that the film was distorting the Quran and derogating the Islamic faith.
What was the controversy?
The controversy started when multiple petitions were filed against the movie, initially scheduled for release on June 7 and then June 14.
The petitions claimed that the film violated the Cinematograph Act, 1952, and infringed upon constitutional provisions under Articles 19(2) and 25. The plea sought a ban on the release of the movie. In response, the high court had issued a stay order on its release.
The petitioners then moved the Supreme Court, which last week stayed the release of the movie and directed the high court to hear and take an appropriate decision.
Then, a division bench of Justices BP Colabawalla and Firdosh Pooniwalla reviewed the film and recommended that the makers do the necessary changes and then release the movie.
The modifications included
- Removing a specific dialogue and a Quranic verse
- Adding two disclaimers of 12 seconds each.
- Adding an extra verse from the Quran as requested by the petitioners.
Mutual Agreement on Changes
Makers of the Movie have agreed to edit out some objectionable content from the film. The petitioners also said they do not have any objection against the release of the movie once the changes are made.
The high court acknowledged that the trailer that was released without CBFC certification was problematic even though it found no content that was objectionable to women, the Muslim community, or the Quran. Now, the filmmakers are fined Rs 5 lakh by the court for this oversight. The petitioners will donate the fine to a charitable organisation.
High court emphasised that the film aims to uplift women and dismissed concerns about the Indian public being misled as they are not ‘silly’.
The film's makers have also assured that they will secure the necessary certification from the Central Board for Film Certification (CBFC) before the new release date. "Hamare Baarah" is now expected to hit theatres on June 21, 2024.
