The Supreme Court of India has ruled that foreign lawyers and law firms can now practice in the country on a "fly-in and fly-out" basis, as well as provide legal advice on foreign law. This decision overturns a previous ruling by the Bombay High Court that barred foreign lawyers from practicing in India.
The court's decision comes after years of debate on the issue, with proponents arguing that it will enhance the quality of legal services in India and attract more foreign investment to the country. However, some legal professionals and industry associations have expressed concern about the potential impact on domestic lawyers and law firms.
The ruling stipulates that foreign lawyers and firms will be subject to Indian regulations and will only be allowed to offer advice on matters involving foreign law. They will not be allowed to practice Indian law or represent clients in Indian courts without permission from the Bar Council of India.
